My.AgesOfAthiria.com Service Rules & Code of Conduct
This Agreement was last updated on June 11th, 2003.
 
PLEASE READ THIS AGREEMENT CAREFULLY.
 
These Service Rules form a part of the User Agreement for the my.AgesOfAthiria.com web site (inlcuding the Ages of Athiria game, the “Site”).
1. About our Services.
 (a) my.AgesOfAthiria.com Services. The Site contains information to assist our users and fans in keeping up with the events following the Game. To assist our users, we provide tools such as message boards, frequently asked questions (FAQs) and personalized settings. While services on the Site are presently free, this will change when the Game is shipped to retail stores for general sales to consumers.
 (b) Availability. The availability of this Site depends on many factors, including some factors that are beyond EPI’s control, such as your connection to the Internet and the Internet backbone. EPI shall not be liable to you if you cannot use this Site due to any reason beyond EPI’s direct control.
 (c) Downloading Material. Any material downloaded or otherwise obtained through the Site is done at your own discretion and risk, and you will be solely responsible for any potential damage to your computer system or loss of data that results from the download of any such material. No advice or information, whether oral or written, obtained by you from the any EPI sites, our third party service providers, or through or from the service will create any warranty between you and EPI.
 
2. Usage Requirements
Usage of my.AgesOfAthiria.com comes with a few mandatory guidelines called “Usage Requirements” Any conduct that violates the “Usage Requirements” is grounds for termination of your account. For this reason, we ask that you carefully read and follow them.
 
 (a) Provide Accurate Information. You agree to provide true, accurate, current and complete information about yourself as requested in the Sites’ registration forms.(“Registration Data”) Accurate records help us create better sites and personalize information to make your stay more enjoyable. Please update the Registration Data to keep it current and accurate.
 (b) Guard Your Password. You are responsible for maintaining the confidentiality of your password and account and you are fully responsible for all activities that occur using your password or account. Please notify EPI immediately of any unauthorized use of your password or account.
 (c) Obey the Law. You agree not to use this Site for illegal purposes or for the transmission of material that is unlawful, harassing, libelous (untrue and damaging to others), invasive of another's privacy, abusive, threatening, or obscene, or that infringes the copyrights or other intellectual property of others.
 (d) Limits on Uses of User Information. By using the Site you agree not to data scrape, copy, aggregate, redistribute, alter, reproduce or re-use for commercial purposes any user's (whether specific to any particular user or as an aggregation) information accessible through the Site. "Commercial purposes" can include but is not limited to selling, renting or licensing information to third parties or using the data for targeted marketing campaigns not affiliated with EPI. EPI reserves the right to take immediate action against any individual or entity participating in any of the prohibited actions mentioned above.
 
3. Endorsement of Member Content.
You acknowledge and agree that EPI does not endorse the content of any user other than content that has been authorized by EPI. EPI is not responsible or liable for any unauthorized content, even though it may be unlawful, harassing, libelous, privacy invading, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable, or that it infringes or may infringe the intellectual property or other rights of another. You acknowledge that the Site does not pre-screen all content, but that the EPI has the right (but not the obligation) in its sole discretion to refuse, edit, move or remove any content that is publicly available via the Site.
 
4. Communities
Registering for the Site grants access to the Community Forums (the "Forums"). You agree to use the Forums only to post information and send and receive messages and material that are proper and related to the particular forum. By way of example, and not as a limitation, you agree that when using Forums, you will not:
 
 * Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
 * Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.
 * Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents.
 * Upload files, post or publish content that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer.
 * Advertise or offer to sell any goods or services for any commercial purpose.
 * Conduct or forward surveys, contests, pyramid schemes or chain letters.
 * Download any file posted by another user of a forum that you know, or reasonably should know, cannot be legally distributed in such manner.
 * Restrict or inhibit any other user from using and enjoying the message boards.
 * Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
 
EPI has no obligation to monitor the Forums or the content posted on them. However, EPI reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in EPI's sole discretion.
 
The Forums are a public forum and not private communications and others may read your communications without your knowledge. You should not have any expectation of privacy relative to your communications on the Forums. Always use caution when giving out any personally identifying information about yourself in any message board community.
 
EPI does not control or endorse the content, messages or information found in any community that is posted by anyone other than an EPI employees therefore EPI specifically disclaims any liability with regard to the Forums and any actions resulting from your participation or the participation of others on any of the Forums.
 
5. My.AgesOfAthiria.com Message Board Rules
The my.AgesOfAthiria.com Message Boards (“Boards”) are a public forum and, though we also ask that you follow a few basic rules. By using or participating on the Boards, you agree to the additional rules as stated below, as well as the EPI User Agreement here.
 
Should you have questions, suggestions or other comments regarding the Boards, the appropriate individual to contact is webmaster@agesofathiria.com. Please include the name you use on the Boards and your real name in any inquiry.
 
Here are some things you'll want to keep in mind while posting on the Boards:
 Copyrighted Material
 Board users agree not to post any material that is protected by copyright, trademark or other proprietary rights without the express prior permission of the owner(s).
 Flaming, Bashing, Trolling, Profanity and Spam
 Hate posts and personal attacks will not be tolerated on the Boards. Treat others on these message boards as you would expect them to treat you. Talking trash about another user is a quick way to earn a banning, as is posting topics specifically to provoke a negative response from someone (aka trolling).
 Keep offensive language to a minimum. What you hear on network television (no, NOT cable) or radio is probably within the bounds of acceptable behavior just don't go overboard. A simple rule to follow is: "when in doubt, don't say it." You don't have to use excessive profanity to get your point across, and it's usually better to avoid it altogether.
 Purposely spamming a message board with senseless, vacuous, or empty messages to gain more stars is highly frowned upon! This includes such things as party posts, chain letters, two-word "I agree" or "me too" responses, continually posting the same topic on a particular board, and posting the same question across several boards.
 
Piracy, ROMs, and Warez
EPI has a very strict policy against piracy, ROMs, Warez, and the illegal use of copyrighted material. Linking or giving information about any site that distributes illegal software, ROMs, media, or emulators, seeking help to circumvent any copyright laws, admitting to possessing and/or distributing illegal copyrighted material, or encouraging software or media piracy is grounds for an immediate cancellation of access to the Site. This goes for all copyrighted material, including but not limited to games, movies, music, and videos.
 
Impersonating Other Users / Accessing Another User's Account
You may not impersonate another board member or create an account specifically for the purpose of provoking other users. Also, accessing or using someone else's account or attempting to access another poster's account is strictly prohibited.
 
Circumventing a Ban
If you log onto the Site and receive a message that you have been banned, please submit an unban request and wait for a EPI Customer Service Representative to get in touch with you. It is not acceptable to return to the boards under another username. If you do, your ban time may be extended.
 
Questionable Content
This rule covers everything else not specifically mentioned in this document. These are public boards, so act like you would if you were in a public place. Issues falling under this rule are left to the discretion of the moderators and EPI employees, but may include any material that is knowingly false and/or defamatory, misleading, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person's privacy, that otherwise violates any law, or that encourages conduct constituting a criminal offense. EPI, its employees and the Boards’ moderators reserve the right to edit or remove any message containing questionable content without notification or explanation at any time.
 
Also note that the Board Rules extend to all areas of the Site, including but not limited to, Private Messages, Signatures, and Unban Requests.
